1. Scope of Application
(1) These Terms and Conditions apply to all services provided by Sofiya’s Vocal Coaching, in particular:
a) 1:1 vocal coaching (online; potentially occasionally in person in the future), offered as individual sessions or package services,
b) Workshops (online and/or in person),
c) Subscriptions (recurring services).
(2) Deviating terms of the client shall not apply unless Sofiya’s Vocal Coaching expressly agrees to their validity in text form.
2. Subject of Services and Limitation
(1) The subject of the services is vocal coaching / singing lessons for the development of the voice and vocal abilities.
(2) No specific success is guaranteed. Progress is individual and depends, among other things, on the starting point, practice, and implementation.
(3) Coaching does not replace medical, psychotherapeutic, or speech therapy treatment. In case of persistent hoarseness, pain, or health complaints, medical advice should be sought in advance.
3. Conclusion of Contract / Booking
(1) The presentation of services on the website does not constitute a legally binding offer but an invitation to book.
(2) A contract is concluded once the client books via the website (Wix), by email, or through an integrated booking system and Sofiya’s Vocal Coaching confirms the booking (an automated confirmation is sufficient).
(3) For package bookings, the contract applies to the booked package scope within the respective term (see Section 6).
4. Prices, Payment Terms, Invoicing
(1) The prices stated at the time of booking or individually agreed prices apply.
(2) Services must be paid in advance (single session, package).
(3) Subscription payments are collected monthly via SEPA direct debit.
(4) Payment is made using the payment methods offered during the booking process, in particular PayPal and/or other payment methods provided by Wix.
(5) Invoices are provided electronically via email.
5. Duration of Sessions and Implementation
(1) A 1:1 session lasts 45 minutes unless otherwise expressly agreed.
(2) Online sessions and workshops are conducted via video call. Clients are responsible for ensuring a stable internet connection, functioning audio/video equipment, and a suitable, low-distraction environment. Online lessons require downloading and setting up the Zoom desktop app, preferably on a laptop or computer.
(3) In-person appointments take place at the agreed location. Clients are responsible for arriving on time.
6. Packages: Scope, Term, and Redemption
(1) Packages consist of a defined number of 45-minute sessions, held at the agreed frequency starting from the start date specified at booking.
(2) Package S: Term of 3 months from the start date; typically 2 sessions per month (6 sessions total), unless otherwise described in the offer.
(3) Package L: Term of 3 months from the start date; typically 4 sessions per month (12 sessions total), unless otherwise described in the offer.
(4) Unused sessions expire after the respective term unless statutory provisions provide otherwise or an extension has been agreed in text form.
(5) Transfer of packages to other persons is only possible with prior consent in text form.
7. Rescheduling, Cancellation, No-Show (1:1)
(1) Agreed 1:1 appointments may be rescheduled or canceled free of charge up to 48 hours before the scheduled start time. Canceled appointments must be rescheduled within 1 month (via website booking) to avoid expiration.
(2) If canceled or rescheduled less than 48 hours before the appointment, the session will be charged in full or counted as used in the case of packages, unless the client proves that no or significantly less damage has occurred.
(3) In the case of a no-show without cancellation, the session will be charged in full or counted as used. In case of late arrival, only the remaining session time will be provided.
8. Workshops: Cancellation and Rebooking
(1) Unless otherwise stated in the workshop description, the following cancellation policy applies:
a) Cancellation up to 14 days before the workshop: free of charge.
b) Cancellation 13 to 7 days before the workshop: 50% of the participation fee.
c) Cancellation less than 7 days before the workshop: 100% of the participation fee.
(2) If the vacated spot can be filled by a replacement participant, only the actual difference incurred will be charged.
(3) Rebooking is possible subject to availability and prior agreement.
9. Subscriptions: Term, Cancellation, Pauses
(1) Subscriptions include recurring services (e.g., a defined number of 45-minute sessions per month) for a recurring fee. The specific scope of services is defined in the respective subscription model.
(2) Subscriptions may be canceled with one month’s notice to the end of the respective minimum term. After expiry of the minimum term, the subscription continues indefinitely and may be canceled at any time with one month’s notice.
(3) Cancellation must be made in text form (e.g., email). Alternatively, cancellation may be processed electronically under the existing account on the booking website.
(4) A pause may be possible upon individual agreement; there is no entitlement to a pause.
10. Cancellation by Sofiya’s Vocal Coaching
(1) If an appointment or workshop is canceled for reasons attributable to Sofiya’s Vocal Coaching (e.g., illness or vacation), a replacement date will be offered or the fee refunded.
(2) Further claims (e.g., reimbursement of travel or consequential costs) exist only in cases of intent or gross negligence.
11. Duties of Cooperation and Health
(1) Clients shall inform Sofiya’s Vocal Coaching in advance about relevant health restrictions, vocal complaints, or strain.
(2) Clients practice at their own responsibility and must respect physical limits. In case of pain, throat or respiratory illness, or persistent hoarseness, practice must be discontinued and medical advice sought.
12. Copyright and Rights of Use
(1) All documents, exercises, audio/video content, and other materials are protected by copyright.
(2) Clients receive a simple, non-transferable right of use for private purposes. Distribution or publication is not permitted without express consent in text form.
13. Confidentiality and Recordings
(1) Content from 1:1 sessions will be treated confidentially.
(2) Recordings (audio/video) are made only with the prior explicit consent of both parties and will not be shared with third parties without the client’s consent.
14. Right of Withdrawal (Consumers)
(1) Consumers generally have a statutory right of withdrawal for distance contracts.
(2) In the case of services, the right of withdrawal may expire prematurely under statutory conditions if the client expressly requests that Sofiya’s Vocal Coaching begin performance before the withdrawal period expires and confirms awareness of the expiration.
(3) Details are provided in a separate withdrawal policy and during the booking process (via checkboxes).
15. Liability
(1) Sofiya’s Vocal Coaching is liable without limitation in cases of intent and gross negligence and in cases of injury to life, body, or health.
(2) In cases of slight negligence, liability exists only for the breach of essential contractual obligations and is limited to the typically foreseeable damage.
(3) Liability for indirect damages is excluded to the extent permitted by law.
16. Data Protection

17. Final Provisions
(1) German law applies.
(2) Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
(3) The place of jurisdiction, where legally permissible, is the registered office of Sofiya’s Vocal Coaching.
18. Minors and Duty of Supervision
(1) The participation of minors in in-person lessons (on-site sessions) requires the consent of their legal guardians.
(2) For in-person lessons, the duty of supervision by Sofiya’s Vocal Coaching is limited exclusively to the duration of the respective lesson and to the immediate teaching space.
(3) No supervision is provided beyond this scope, in particular before the start and after the end of the lesson or during arrival and departure. The responsibility for drop-off and pick-up lies with the legal guardians.
(4) For online lessons, no duty of supervision can be assumed. Responsibility for participation and supervision lies entirely with the legal guardians.
